Notice to Investors

Dear Investor

Today in the NSW Supreme Court, Basis Capital Funds Management Limited as Responsible Entity for the Basis Yield Fund and Basis Aust-Rim Diversified Fund intended to seek directions from the Magistrate to appoint certain parties as defendants representing members of the Funds, June Applicants and June Redeemers.

However, after an appearance at Court by the representatives of the Basis Yield Alpha Master Fund ("BYAMF") and an indication by them that they were considering any potential interest they may have in the proceedings, it was agreed by all parties to defer the proceedings pending the clarification of BYAMF's position.
